MOTOR VEHICLE AND TRAFFIC CODE

San Andreas recognizes no “right to drive,” and instead has a “privilege to drive” approach to violations of its motor vehicle laws.
45 MPH – Speed Limit in a Construction Zone (Equipment or SADOT vehicles on roadways)

Otherwise refer to clearly posted limits (Radar/minimap has a display of limits)

A person must hold a valid license and be in possession of that license, in order or lawfully operate a motor vehicle in this state.

No person shall consume intoxicating substances prior or during operating a vehicle. This includes but is not limited to marijuana, cocaine, meth, acid or any other intoxicating substances

The legal BAC allowed under law is .08.

The San Andreas DMV has given the SASP the legal authority to suspend a persons driving privileges under a certain number of circumstances i.e
  • Egregious acts of DWI, Reckless/Careless Driving, Violation of emergency vehicle yield.

MOVING VIOLATIONS
SA-13.01 – Driving While License or Privileges Revoked or Suspended
Any person whose driver's license or driving privilege has been canceled, suspended or revoked and is operating a motor vehicle.
SA-13.02 – Hit and Run – Bodily Injury
  • Outcome of an auto collision consisting in the infliction of a serious bodily injury. The motorist then knowingly leaves the scene of the accident not calling emergency services or assisting injured persons.
SA-13.03 – Hit and Run – Property Damage
  • Outcome of an auto collision where the motorist damages property and leaves the scene knowingly without contacting proper authorities.
SA-13.04 – DWI
  • A person commits the offense when operating the motorized/non motorized vehicle if he/she operates upon a roadway, any street, or any public zoned area with a BAC above the legal limit or while under the influence of an impairing substance.
SA-13.05c – Speeding 14-29 MPH Over Posted Limit
  • Motorists are clocked by Radar, Lidar, Aircraft, or Pacing traveling in excess of the posted limit by 14-29 MPH.
  • Measuring device has been calibrated to properly display the infractions speed.
SA-13.05b – Speeding 10-19 MPH Over Posted Limit
  • Motorists are clocked by Radar, Lidar, Aircraft, or Pacing traveling in excess of the posted limit by 10-19MPH.
SA-13.05a. – Speeding 1-9 MPH Over Posted Limit
  • Motorists are clocked by Radar, Lidar, Aircraft, or Pacing traveling in excess of the posted limit by 1-9MPH.
SA-13.06 – Street Racing
  • It shall be unlawful for any person to operate a motor vehicle on a street or highway willfully in either prearranged or not prearranged fashion in a speed competition with another motor vehicle.
SA-13.07 – Reckless Driving
  • Irrespective of the maximum speeds permitted by law, any person who drives a vehicle on any highway recklessly or at a speed or in a manner so as to endanger the life, limb or property of another person shall be guilty of reckless driving.
    • Driving 100 MPH and above
    • Racing another vehicle.
    • Trying to elude a police officer.
    • Passing another vehicle when visibility of oncoming traffic is limited.
SA-13.08 – Aggressive Driving
  • Any person who operates a motor vehicle on a street, highway, or public vehicular area is guilty of aggressive driving if the person commits (2) or more of these violations;
    • Drives carelessly and willingly disregard the rights or safety of others.
    • Running a red light.
    • Running through a stop sign.
    • Illegal passing.
    • Failing to yield right-of-way.
    • Following too closely.
    • Excessive speed past posted limits.
SA-13.09 – Illegal Passing
  • An operator of a motor vehicle may not pass on the right shoulder of the roadway to overtake another vehicle, nor pass on the left when double yellow lines are marked on the road's surface.
  • A Motorist shall slow when passing a bicycle.
SA-13.10 – Following Too Closely
  • The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of the vehicles and the traffic upon and the condition of the highway.
SA-13.11 – Driving on Wrong Side of Road
  • Except as otherwise provided by law, on all highways of sufficient width, the driver of a vehicle shall drive on the right half of the highway, unless it is impracticable to travel on such side of the highway and except when overtaking and passing.
SA-13.12 – Failure to Observe Traffic Control Device (Sign/Light)
  • The driver of any vehicle shall obey the instructions of any official traffic control device. This applies to traffic lights and displayed road signs.
SA-13.13 – Speeding Through Safety Zone
  • No driver of a vehicle shall drive through or over a safety zone.
SA-13.14 – No Operators License
  • Operator does not hold a license while driving a motor vehicle on city or state roadways.
SA-13.15 – Failure to Yield Right of Way
  • Driver fails to properly yield to oncoming or parallel traffic and observe a proper Right of Way.
SA-13.16 – Failure to Yield to Emergency Vehicle
  • Motorists fail to yield or stop for an oncoming siren in use by an emergency vehicle.
SA-13.17 – Failure to Display License Plate
  • Operators of a vehicle under their ownership of another person, are responsible for the display of a license plate registered through San Andreas DMV. The license plate must be clearly mounted to the rear of the vehicle and observable to a passing motorist.
SA-13.18 – Improper Window Tint
  • Vehicle shows application of an illegal window tinting/sunshield film. Percent's less than 50% are illegal. Further violation if the tint color is any shade other than black or light blue.
SA-13.19 – Illegal Vehicle Modification
  • Nitrous Oxide
  • Underglow colors that are red or blue in color
  • Hydraulic aftermarket equipment operated on public roadways
  • Slick Tires
  • Ballistic plating.
  • Headlights that omit any other color than white light
SA-13.20 – Use of Unsafe Vehicle
  • No person shall drive or move on any street or highway in any motor vehicle, trailer, or combination, unless the vehicle is in good working order.
  • Vehicles suspected to be in violation of this statute are subject to inspection by a Law Enforcement Officer.
SA-13.21 – Failure to use Restraint Device
  • Motorists shall wear a seatbelt or restrain their child in a motor vehicle while traveling in motion on any roadway.
SA-13.22 – Failure to maintain lane
  • Operating your motor vehicle not keeping your vehicle within the proper lanes marked on the roadway.
SA-13.23 – Helmet Law
  • Operating a motorcycle without a U.S.D.O.T. certified helmet.
SA-13.24 – Improper Parking
  • Parking on a sidewalk, outside of lanes, in a fire lane, in an area not designated, or another improper parking area as defined by the peace officer.
SA-13.25 – Move Over Law
  • Requires motorists to move over into the adjacent lane of traffic, when safe to do so, or alternatively to slow down to below half the posted speed limit for emergency vehicles, or tow vehicles.
SA-13.26 – Operation of unregistered vehicle
  • Operating a motor vehicle without registration documentation in person to show law enforcement. Failure to pay the fee associated with the documentation, or operating the vehicle while papers are expired.
SA-13.27 – Operation of a recreational vehicle on a public roadway
  • Operating a motor vehicle defined as recreational on public roadways is strictly prohibited.
